We collect personal information when providing services to merchants, including those using Top Points for loyalty and points programs. We also collect, manage, and secure data directly from clients, such as when users create or use accounts within the Top Points ecosystem.

2. Merchants and Business Data:
Most of the information collected about merchants is commercial rather than personal. Any private information we collect supports our understanding of the merchants’ needs and allows us to provide and improve our services. This information is used solely within Top Points to enhance service quality and user experience.

3. Data Collection and Image Use:
Our app may request access to a user’s device camera or photo library for uploading profile images, avatars, and (for merchants) store logos. These images are stored securely, used only to support app functionality, and are optional for all users. Top Points does not collect any data from images beyond their intended purpose, and no data is collected automatically.

4. Website Data Collection:
We gather personal information that users provide directly on the website, such as reference information and data collected through cookies and similar tools.

5. Privacy Assurance:
Top Points does not sell personal information to third parties. Should our business undergo acquisition or restructuring, this would not constitute a “sale” of user information.

6. Cookies:
Our website and app use session cookies, which are deleted when the browser or app is closed, and collected cookies that remain on your device to help analyze user activity and remember preferences for a more personalized experience.

7. IP Collection:
For security and analytics, we collect users’ IP addresses and browser types, which we store securely for up to 12 months.

8. Equipment and Service Requirements:
It is the user’s responsibility to ensure they have the necessary equipment, devices, and services to access the Top Points website and app. Top Points does not provide equipment, internet access, or other services required to connect to its platform.

9. Service Modifications:
Top Points reserves the right to modify, withdraw, expand, or limit its services, features, or functionalities at any time. Changes may be made for various purposes or without specific cause and may be carried out without prior notice or liability.

Gift Card Transaction Policy for Top Points

1. Gift Card Responsibility Disclaimer:
Top Points Group is not liable for any issues arising from unauthorized use, loss, or disputes related to gift card transactions. We recommend safeguarding your gift card details and contacting support in case of any issues.

2. Card Value and Expiry Policy:
Gift cards are issued with a value specified at the time of purchase, clearly displayed on the card. Our gift cards have no expiration date, providing customers with greater flexibility for when and how they use their funds.

3. Refunds and Returns:
Gift cards are non-refundable. However, if a purchase made with a gift card qualifies for a refund, the refunded amount will be credited back to the original gift card used for the transaction.

4. Balance Inquiries:
Customers may check their gift card balances at any time through the Top Points website or app, providing easy access to manage and track gift card use.

5. Transferability and Resale:
Gift cards are transferable, allowing customers to share them with others as gifts. While resale of gift cards is permitted, Top Points recommends caution when purchasing gift cards from third parties to ensure authenticity.

6. Privacy and Data Security for Gift Card Information:
All customer information associated with gift card transactions is handled with the highest standards of confidentiality and privacy, following applicable data protection laws. Top Points is committed to safeguarding user information and ensures that personal data remains secure.

7. Legal and Regulatory Compliance:
Our gift card policy complies with relevant laws and regulations governing gift card transactions. Top Points monitors for regulatory changes to ensure ongoing compliance.

8. Policy Updates:
Top Points reserves the right to modify its gift card policy as needed to ensure consistency with operational changes and legal requirements. Updates to this policy will be communicated through our website and app to keep users informed.

9. Activation and Purchase Requirements:
Gift cards must be activated at the time of purchase, either online or in-store, depending on the merchant’s policy. The purchaser bears responsibility for ensuring correct activation and the appropriate loading of funds onto the card.

10. Redemption Options and Conditions:
Gift cards can be used to make purchases at the issuing retailer or within a group of affiliated businesses. Top Points policies may specify whether a gift card is valid for online, in-store, or both types of transactions, based on merchant agreements.

11. Expiration and Usage Periods:
While Top Points gift cards generally do not expire, certain affiliated businesses may set usage timelines. If such policies apply, they will be clearly communicated at the point of sale and during the redemption process.

12. Lost or Stolen Cards:
Top Points provides limited assistance in cases where gift cards are lost or stolen. Specific policies regarding lost or stolen gift cards may apply, and customers should reach out to Top Points support for guidance.

13. Non-refundable Nature of Gift Cards:
Gift cards are non-refundable and non-transferable beyond the initial purchase conditions set forth by Top Points and our participating merchants.

14. Fees:
Certain gift cards may carry fees for activation, balance inquiries, or inactivity if a card remains unused for a designated period. All fees are disclosed at the point of purchase, and customers can contact support for further information.

15. Inactivity Fees:
Inactivity fees may apply to certain gift cards if unused for an extended time. If applicable, these fees are clearly outlined within Top Points terms and at the time of purchase.

16. Designating an Authorized Representative:
If you wish to designate someone to manage your account rights on your behalf, please email us with the request from the email associated with your account. Top Points requires email verification to confirm your identity and authorize such requests.

Reservation and Points – Terms and Policy

Last updated: [2025 – 08 – 28] These Terms and Policies (“Terms”) govern the use of the Reservation and Points Program (“Program”) offered by TOP POINTS. By making a reservation, earning, or redeeming points, you agree to comply with these Terms.         Reservations
  • Reservations must be made through the approved TOP POINTS App.  A valid method of payment may be required to secure a reservation.
  • Reservations are subject to availability and confirmation or auto booking.
  • Customers must comply with all rules, policies, and conditions associated with their reservation.
        Points Accumulation
  • Customers may earn points for eligible reservations, purchases, or promotions as specified.
  • Points are calculated based on the net amount paid 
  • Points earned will be credited to your account within 24 Hours of completing the eligible activity.
  • Points have NO CASH value and cannot be exchanged for money.
        Points Redemption
  • Points may be redeemed for eligible reservations, discounts, rewards, 
  • Redemption is subject to availability, terms of the reward, and applicable restrictions.
  • Once redeemed, points cannot be reinstated or transferred.
  • Partial redemptions may not be allowed unless explicitly stated.
         Cancellations and Modifications
  • Reservation cancellations or modifications must follow the policy displayed at the time of booking.
  • If a reservation is cancelled, points earned may be deducted from your account.
  • If points were used for a reservation and the reservation is cancelled, the points may be refunded, subject to cancellation rules.
  • No-shows may result in forfeiture of points and/or reservation fees.
        Expiration of Points
  • Points are valid from the date of earning, unless otherwise specified.
  • Expired points will be automatically removed from your account and cannot be reinstated.
        Account Management
  • Each customer is responsible for maintaining the security of their account credentials.
  • Fraudulent, abusive, or suspicious activity may result in forfeiture of points and/or account suspension.
       Changes and Termination
  • The Company reserves the right to modify, suspend, or terminate the Program at any time, with or without notice.
  • Changes may include adjustments to point values, expiration policies, eligible activities, or redemption options.
  • In the event of termination, unused points may be forfeited without compensation.
         Limitation of Liability
  • The Company is not responsible for:
    • Errors in reservation processing, points calculation, or redemption.
    • Technical issues or system outages.
    • Third-party services or products obtained through the Program.
  • The Program is provided “as is” without any warranties, express or implied.
       Governing Law
  • These Terms are governed by the laws of Canada.
